Terms of Service for PINKY Platform

Introduction

Welcome to PINKY, operated by KEROFI PTE. LTD., Singapore. These terms govern your use of the PINKY platform, including the creation, purchase, and sale of NFTs incorporating AI-generated artwork and metadata.

Chapter 1: Acceptance of Terms

By using the services provided by PINKY, you agree to these terms of service.

These terms may be updated from time to time without notice. Continued use of the service means acceptance of the updated terms.

Chapter 2: Intellectual Property

The intellectual property rights of content created on PINKY belong to the creators. However, KEROFI PTE. LTD. retains final authority over the management of these rights on the platform.

The metadata, including prompts and models used in the creation of content, is a crucial part of the transparency and originality of the NFTs and is recorded accordingly.

Chapter 3: Use of Service

Users must respect the intellectual property and privacy of others.

Images are generated by AI, and there is a possibility that inappropriate images might be generated or displayed. Usage by minors is discouraged.

Any activity deemed to be in violation of the public order or morality may result in suspension or expulsion from the platform.

Chapter 4: Service Interruption and Liability

KEROFI PTE. LTD. is not liable for any service interruption, data loss, or damage resulting from cyber attacks or any other causes beyond reasonable control.

Users are responsible for resolving any disputes arising from the use of PINKY amongst themselves.

Chapter 5: Prohibited Conduct

Users of PINKY must not engage in activities that:

• Infringe on copyright, trademark, or any other intellectual property rights.
• Include hate speech, discrimination, harassment, bullying, defamation, privacy invasion, unauthorized access, hacking, malware distribution, spamming, phishing, fraud, illegal advertising, unlawful trade, illegal file sharing, inappropriate adult content, violence, gambling, misuse of third-party accounts, dissemination of fake news, security evasion, excessive system resource usage, nuisance to other users, illegal drug or weapon sales, exposure of inappropriate content to minors, spreading misinformation, promoting illegal activities, anti-competitive actions, unpermitted promotional activities, misuse of service APIs, and any other activities contrary to applicable laws and regulations.

Chapter 6: Governance

Should a DAO be established, it will govern the permissibility of actions according to its decision-making mechanisms.

Chapter 7: Amendments

These terms can be amended by KEROFI PTE. LTD. or through DAO governance procedures

Chapter 8: Jurisdiction

Disputes arising under these terms shall be governed by the laws of Singapore.
